FSE What's Up #3 on Potestative Clauses and Screenwriters’ Contracts : Between Apparent Creative Freedom and Voluntary Servitude - Denis Goulette's presentation
Last Tuesday the FSE held the third edition of our “What’s Up Meetings” on Potestative Clauses and Screenwriters’ Contracts : Between Apparent Creative Freedom and Voluntary Servitude . The meeting gathered 20 participants.
The purpose of the presentation and discussion was to explore – in the context of rewriting - on what legal basis can one party alone decide when the other gets paid and how general civil law principles (not copyright law) can help analyse certain rewriting practices between producers and screenwriters. Drawing on examples from several European legal systems, the presentation examines where legitimate creative collaboration ends and where unilateral contractual power begins. The session offered concrete, transposable tools for guilds and screenwriters seeking to better frame development processes and protect creative freedom.
